of the business company

company ID (IČO): 09697527

email: info@huggie.cz

registered in the Commercial Register kept by the Regional Court in Ostrava, Section C, File 83916, for the sale of goods through the online shop located at www.huggie.cz and www.huggie.eu

1. Introductory provisions

  1. These terms and conditions (the “Terms and Conditions”) of the business company FreshDeal s.r.o., with its registered office at Prievidzská 2921/23, 787 01 Šumperk, Czech Republic, company ID: 09697527, registered in the Commercial Register kept by the Regional Court in Ostrava, Section C, File 83916 (the “Seller”), govern, in accordance with Section 1751(1) of Act No. 89/2012 Coll., the Civil Code, as amended (the “Civil Code”), the mutual rights and obligations of the contracting parties arising in connection with or on the basis of a purchase contract (the “Purchase Contract”) concluded between the Seller and another natural person who is a consumer (the “Buyer”) through the Seller’s online shop. The online shop is operated by the Seller on the websites located at www.huggie.cz (Czech version with prices in Czech koruna) and www.huggie.eu (English and other language versions with prices in euros or in the local currency) (the “Website”), through the Website interface (the “Shop Web Interface”).
  2. The Terms and Conditions do not apply to cases where the person intending to purchase goods from the Seller is a legal entity or a person acting, when ordering goods, in the course of their business or independent profession.
  3. Provisions deviating from the Terms and Conditions may be agreed in the Purchase Contract. Deviating arrangements in the Purchase Contract take precedence over the provisions of the Terms and Conditions.
  4. The provisions of the Terms and Conditions form an integral part of the Purchase Contract. The Purchase Contract may be concluded in Czech or in the language of the version of the Shop Web Interface used by the Buyer when placing the order.
  5. The Seller may amend or supplement the wording of the Terms and Conditions. The Purchase Contract is governed by the wording of the Terms and Conditions in effect at the time the order is sent. This provision does not affect rights and obligations arising during the effectiveness of the previous wording of the Terms and Conditions.

2. Conclusion of the Purchase Contract

  1. All presentation of goods in the Shop Web Interface is for information purposes only, and the Seller is not obliged to conclude a Purchase Contract regarding such goods. Section 1732(2) of the Civil Code does not apply.
  2. The Shop Web Interface contains information about the goods, including their main characteristics, price and availability. Goods marked “On order” are not held in the Seller’s own warehouse and are obtained by the Seller from its supplier; for such goods, the expected delivery time is stated in the Shop Web Interface. The Seller is not a payer of value added tax (VAT); the prices of goods are therefore stated as final, without VAT, and include all related charges except the costs of delivery and any cash on delivery fee, which are stated separately. The prices of goods remain valid for as long as they are displayed in the Shop Web Interface. This provision does not limit the Seller’s ability to conclude a Purchase Contract on individually agreed terms.
  3. The Shop Web Interface also contains information about the available delivery and payment methods and the costs of delivering the goods to the individual countries, on the “Shipping and payment” page and in the checkout. The total price of the order, including the costs of delivery and any cash on delivery fee, is shown to the Buyer before the order is sent.
  4. To order goods, the Buyer fills in the order form in the checkout of the Shop Web Interface (no registration is required). The order form contains in particular information about:
    • the goods being ordered (the Buyer “places” the goods in the electronic shopping cart of the Shop Web Interface),
    • the country of delivery, the delivery method and the delivery address or chosen pickup point, the method of paying the purchase price and the Buyer’s contact details (name, email, phone), and
    • the costs of delivering the goods (together the “Order”).
  5. Before sending the Order to the Seller, the Buyer is allowed to check and change the data entered in the Order, including with regard to the Buyer’s ability to detect and correct errors made when entering data into the Order. The Buyer sends the Order to the Seller by clicking the “Place order & pay” button (payment by card) or the “Place order with obligation to pay” button (cash on delivery). The Buyer must state all data in the Order correctly and truthfully; the data stated in the Order are considered correct by the Seller.
  6. After receiving the Order, the Seller sends the Buyer an order confirmation by email, to the email address stated in the Order (the “Buyer’s Email Address”). For card payments, the Order is accepted and the confirmation is sent only after the payment has been successfully completed. If the Buyer does not complete the card payment within 3 hours of sending the Order, the Order is automatically cancelled and no Purchase Contract is concluded.
  7. The contractual relationship between the Seller and the Buyer arises upon delivery of the order confirmation (acceptance) to the Buyer’s Email Address. The order confirmation contains a summary of the Order, a link to the invoice and, as an attachment, these Terms and Conditions in text form.
  8. Depending on the nature of the Order (quantity of goods, amount of the purchase price, expected transport costs), the Seller is entitled to ask the Buyer for an additional confirmation of the Order (for example by email).
  9. The Buyer agrees to the use of means of distance communication when concluding the Purchase Contract. Costs incurred by the Buyer when using means of distance communication in connection with the conclusion of the Purchase Contract (internet connection costs) are borne by the Buyer, and these costs do not differ from the basic rate.

3. Price of goods and payment terms

  1. The Buyer may pay the price of the goods and the costs of delivery under the Purchase Contract to the Seller in the following ways:
    • cashless by payment card online via the Stripe payment gateway (Visa, Mastercard, Apple Pay, Google Pay), directly while placing the Order;
    • cash on delivery when collecting the parcel, but only where this payment method is offered in the checkout (the availability of cash on delivery depends on the country of delivery, the currency and the carrier).
  2. Together with the purchase price, the Buyer is obliged to pay the Seller the costs of delivering the goods and, for cash on delivery, also the cash on delivery fee in the amount shown in the checkout (CZK 49 or €2, or the equivalent amount in another currency). Unless expressly stated otherwise, the purchase price below also includes the costs of delivering the goods.
  3. The Seller does not require a deposit or any similar payment from the Buyer. Payment by card while placing the Order is payment of the purchase price, not a deposit.
  4. For card payments, the purchase price is due when the Order is sent, and the Buyer’s obligation to pay the purchase price is fulfilled at the moment the payment is successfully completed via the payment gateway. For cash on delivery, the purchase price is due upon receipt of the goods.
  5. The Seller is entitled, in particular if the Buyer does not provide an additional confirmation of the Order (Art. 2.8), to require payment of the full purchase price before the goods are dispatched to the Buyer. Section 2119(1) of the Civil Code does not apply.
  6. On the www.huggie.cz website, prices are stated and paid in Czech koruna; on the www.huggie.eu website, in euros or, depending on the country of delivery, in Polish złoty, Hungarian forint, Romanian lei, Swedish krona or Danish krone. The purchase price is paid in the currency in which the Order was sent. Any currency conversion fees charged by the Buyer’s bank are neither charged nor influenced by the Seller.
  7. Any discounts on the price of goods (discount codes) provided by the Seller to the Buyer cannot be combined.
  8. For every accepted Order, the Seller issues an invoice to the Buyer. The Seller is not a payer of value added tax. The Seller sends the Buyer a link to the invoice in the order confirmation to the Buyer’s Email Address and includes a printed invoice in the parcel.

4. Transport and delivery of goods

  1. Goods are delivered by Zásilkovna s.r.o. (Packeta) and its partner carriers to pickup points, parcel lockers (Z-BOX and partner carriers’ lockers) or to the Buyer’s address, to 26 Member States of the European Union. The list of countries, the available delivery methods and their prices are stated on the “Shipping and payment” page and in the checkout. Delivery to a pickup point in the Czech Republic and Slovakia is free of charge if the value of the Order exceeds the amount stated in the Shop Web Interface.
  2. The Seller usually dispatches goods in stock within 24 hours on business days of accepting the Order (for card payments, of the payment being successfully completed). The Seller usually delivers goods marked “On order” to the Buyer within 7 days of the conclusion of the Purchase Contract; the expected delivery time is marked on the goods. If an Order contains both goods in stock and goods on order, the Seller usually dispatches the Order in one parcel once all the goods are available.
  3. The delivery time after dispatch depends on the country and the delivery method; in the Czech Republic and Slovakia it is usually 1–3 business days, to other countries of the European Union usually 2–7 business days. These times are indicative. The Seller delivers the goods no later than 30 days after the conclusion of the Purchase Contract, unless the parties agree otherwise.
  4. If the Seller is obliged under the Purchase Contract to deliver the goods to the place specified by the Buyer in the Order, the Buyer is obliged to accept the goods upon delivery. For delivery to a pickup point or parcel locker, the Buyer is obliged to collect the parcel within the storage period notified by the carrier.
  5. If, for reasons on the Buyer’s side, the goods need to be delivered repeatedly or in a manner other than that stated in the Order, the Buyer is obliged to pay the costs associated with the repeated delivery or with the other delivery method.
  6. When taking over the goods from the carrier, the Buyer is obliged to check that the packaging is intact and, in the event of any defects, to notify the carrier immediately. If the packaging is found to be damaged in a way indicating unauthorised entry into the parcel, the Buyer does not have to accept the parcel from the carrier. This does not affect the Buyer’s rights arising from defective performance and other rights of the Buyer under generally binding legal regulations.
  7. The risk of damage to the goods passes to the Buyer upon taking over the goods.

5. Withdrawal from the Purchase Contract

  1. The Buyer acknowledges that, under Section 1837 of the Civil Code, it is not possible, among other things, to withdraw from a purchase contract for the supply of goods that have been modified according to the Buyer’s wishes or for the Buyer personally, from a purchase contract for the supply of goods that are perishable, as well as goods that have been irreversibly mixed with other goods after delivery, and from a purchase contract for the supply of goods in sealed packaging which the consumer has removed from the packaging and which cannot be returned for hygiene reasons.
  2. Unless it is a case referred to in Art. 5.1 of the Terms and Conditions or another case where it is not possible to withdraw from the Purchase Contract, the Buyer has the right, in accordance with Section 1829(1) of the Civil Code, to withdraw from the Purchase Contract within fourteen (14) days of receiving the goods; where the subject of the Purchase Contract is several types of goods or the delivery of several parts, this period runs from the day of receipt of the last delivery of goods. The Seller voluntarily extends this period to thirty (30) days from receipt of the goods; withdrawal within the extended period is subject to the same rules as withdrawal within the statutory period. The withdrawal from the Purchase Contract must be sent to the Seller within the period stated in this article. Withdrawal may be made by any unambiguous statement, in particular by email to info@huggie.cz or by letter to the address of the Seller’s registered office; the Buyer may use the model form that forms an annex to the Terms and Conditions. The Buyer may also withdraw by sending the goods back within the period under this article together with accompanying information making it clear that the Buyer is withdrawing from the Purchase Contract (for example, a completed form or the invoice with the order number).
  3. In the event of withdrawal from the Purchase Contract under Art. 5.2 of the Terms and Conditions, the Purchase Contract is cancelled from the outset. The goods must be returned by the Buyer to the Seller within fourteen (14) days of withdrawal from the Purchase Contract, to the returns address:
    AAA PODLAHY (Huggie)
    Jesenická 293
    788 14 Rapotín
    Czech Republic
If the Buyer withdraws from the Purchase Contract, the Buyer bears the direct costs of returning the goods to the Seller. When sending from the Czech Republic, the Buyer may return the goods free of charge via Zásilkovna (Packeta) using the code 97709132; in that case, the return costs are borne by the Seller. When sending from another country or with a different carrier (e.g. Czech Post), the return costs are borne by the Buyer; they correspond to the price of sending a parcel with the carrier chosen by the Buyer. Goods may not be sent cash on delivery.
  4. In the event of withdrawal from the Purchase Contract under Art. 5.2 of the Terms and Conditions, the Seller returns the funds received from the Buyer, including the costs of delivering the goods (up to the cheapest delivery method offered) and any cash on delivery fee, within fourteen (14) days of the Buyer’s withdrawal from the Purchase Contract, using the same means by which the Seller received them: card payments (including Apple Pay and Google Pay) are refunded back to the payment card. If the Buyer paid cash on delivery, the Seller refunds the funds by bank transfer to the bank account notified by the Buyer; this does not cause the Buyer any additional costs. The Seller is not obliged to return the funds received to the Buyer before the Buyer returns the goods or proves that the goods have been sent to the Seller.
  5. The Buyer is liable to the Seller for any reduction in the value of the goods resulting from handling the goods in a manner other than what is necessary given their nature and characteristics (i.e. beyond trying them on). The goods should therefore be returned undamaged and not used beyond trying them on. The Seller is entitled to set off its claim for compensation for the reduction in value of the goods against the Buyer’s claim for a refund of the purchase price.
  6. The Seller is entitled to withdraw from the Purchase Contract before the goods are dispatched only for objective reasons, in particular if the goods can no longer be obtained from the supplier or if an obviously incorrect price of the goods was stated in the Shop Web Interface. The Seller informs the Buyer of the withdrawal immediately by email and refunds all payments received immediately, no later than within fourteen (14) days, using the same means by which they were received, or to an account specified by the Buyer.
  7. If a gift is provided to the Buyer together with the goods, the gift contract between the Seller and the Buyer is concluded subject to a condition subsequent: if the Buyer withdraws from the Purchase Contract, the gift contract regarding such gift ceases to be effective and the Buyer is obliged to return the gift to the Seller together with the goods.

6. Rights arising from defective performance

  1. The rights and obligations of the contracting parties regarding rights arising from defective performance are governed by the relevant generally binding legal regulations (in particular Sections 1914 to 1925, 2099 to 2117 and 2161 to 2174b of the Civil Code and Act No. 634/1992 Coll., on Consumer Protection, as amended).
  2. The Seller is liable to the Buyer for the goods being free of defects upon receipt. In particular, the Seller is liable to the Buyer that the goods:
    1. correspond to the agreed description, type and quantity, as well as quality, functionality and other agreed characteristics,
    2. are suitable for the purpose for which the Buyer requires them and to which the Seller has agreed, and
    3. are supplied with the agreed accessories and instructions for use (for example on care and washing).
  3. The Seller is liable to the Buyer that, in addition to the agreed characteristics:
    1. the goods are suitable for the purpose for which goods of this kind are normally used, also with regard to the rights of third parties, legal regulations, technical standards or codes of conduct of the industry concerned where there are no technical standards,
    2. the goods correspond in quantity, quality and other characteristics, including durability, functionality and safety, to the usual characteristics of goods of the same kind that the Buyer can reasonably expect, also with regard to public statements made by the Seller or another person in the same contractual chain, in particular by advertising or labelling, unless the Seller proves that it was not aware of such statement, or that it had been corrected at the time the Purchase Contract was concluded in at least a comparable way to that in which it had been made, or that it could not have influenced the decision to purchase,
    3. the goods are supplied with accessories, including packaging and instructions for use, that the Buyer can reasonably expect, and
    4. the goods correspond in quality or design to the sample or model that the Seller provided to the Buyer before the conclusion of the Purchase Contract.
  4. Art. 6.3 of the Terms and Conditions does not apply if the Seller specifically informed the Buyer before the conclusion of the Purchase Contract that a certain characteristic of the goods differs, and the Buyer expressly agreed to this when concluding the Purchase Contract.
  5. If a defect becomes apparent within one year of receipt, the goods are deemed to have been defective upon receipt, unless the nature of the goods or the defect precludes this. This period does not run for the time during which the Buyer cannot use the goods, if the Buyer has rightfully notified the defect.
  6. The Buyer may notify a defect that becomes apparent in the goods within two (2) years of receipt. If the Buyer has rightfully notified the Seller of a defect, the period for notifying defects does not run for the time during which the Buyer cannot use the goods.
  7. If the goods have a defect, the Buyer may demand its removal. At the Buyer’s choice, the Buyer may demand delivery of new goods without defects or repair of the goods, unless the chosen method of removing the defect is impossible or disproportionately expensive compared to the other; this is assessed in particular with regard to the significance of the defect, the value the goods would have without the defect and whether the defect can be removed by the other method without significant inconvenience to the Buyer. The Seller may refuse to remove the defect if this is impossible or disproportionately expensive, in particular with regard to the significance of the defect and the value the goods would have without the defect.
  8. The Seller removes the defect within a reasonable time after it has been notified, so as not to cause significant inconvenience to the Buyer, taking into account the nature of the goods and the purpose for which the Buyer purchased them. To remove the defect, the Seller takes over the goods at its own expense.
  9. The Buyer may demand a reasonable discount or withdraw from the Purchase Contract if:
    1. the Seller has refused to remove the defect or has not removed it in accordance with Art. 6.8 of the Terms and Conditions,
    2. the defect recurs,
    3. the defect constitutes a material breach of the Purchase Contract, or
    4. it is clear from the Seller’s statement or from the circumstances that the defect will not be removed within a reasonable time or without significant inconvenience to the Buyer.
  10. If the defect is insignificant, the Buyer cannot withdraw from the Purchase Contract (within the meaning of Art. 6.9 of the Terms and Conditions); a defect is presumed not to be insignificant. If the Buyer withdraws from the Purchase Contract, the Seller refunds the purchase price to the Buyer without undue delay after receiving the goods or after the Buyer proves that the goods have been sent.
  11. The Buyer makes the claim (complaint) to the Seller, in particular by email to info@huggie.cz, stating the order number, a description of the defect and photos of the defect. The Buyer sends the goods complained about to the returns address:
    AAA PODLAHY (Huggie)
    Jesenická 293
    788 14 Rapotín
    Czech Republic
A complaint may also be made at the Seller’s registered office. If the complaint is justified, the costs of sending the goods complained about are borne by the Seller.
  12. When a complaint is made, the Seller is obliged to issue the Buyer with a confirmation (usually by email) stating the date on which the Buyer made the complaint, its content, the method of handling the complaint requested by the Buyer and the Buyer’s contact details for the purpose of providing information on how the complaint has been handled.
  13. The complaint, including removal of the defect, must be handled and the Buyer must be informed thereof no later than thirty (30) days from the date the complaint was made, unless the Seller and the Buyer agree on a longer period.
  14. After the period under Art. 6.13 of the Terms and Conditions has expired without result, the Buyer may withdraw from the Purchase Contract or demand a reasonable discount.
  15. The Seller is obliged to issue the Buyer with a confirmation of the date and method of handling the complaint, including confirmation of the repair and its duration, or a written justification for rejecting the complaint.
  16. A person entitled to rights arising from defective performance is also entitled to reimbursement of costs reasonably incurred in exercising this right. However, if the Buyer does not claim reimbursement within one month after the expiry of the period within which the defect must be notified, the court will not grant the right if the Seller objects that the right to reimbursement was not claimed in time.
  17. This article of the Terms and Conditions also serves as the Seller’s complaints procedure.
  18. The Seller or another person may provide the Buyer with a quality guarantee in addition to the Buyer’s statutory rights arising from defective performance.

7. Other rights and obligations of the contracting parties

  1. The Buyer acquires ownership of the goods upon payment of the full purchase price of the goods.
  2. The Seller is not bound by any codes of conduct in relation to the Buyer within the meaning of Section 1826(1)(e) of the Civil Code.
  3. Consumer complaints are handled by the Seller via the email address info@huggie.cz. The Seller sends information on how the Buyer’s complaint has been handled to the Buyer’s Email Address.
  4. The Czech Trade Inspection Authority (Česká obchodní inspekce), with its registered office at Gorazdova 1969/24, 120 00 Prague 2, Czech Republic, company ID: 000 20 869, website: www.coi.cz, is competent for the out-of-court resolution of consumer disputes arising from the Purchase Contract.
  5. A Buyer residing in another Member State of the European Union may, in the event of a dispute, also contact the European Consumer Centre in their country, the European Consumer Centre Czech Republic (website: www.evropskyspotrebitel.cz), or the body for out-of-court resolution of consumer disputes in their country.
  6. The Seller is authorised to sell goods on the basis of a trade licence. Trade inspection is carried out within its competence by the relevant Trade Licensing Office. Supervision of personal data protection is exercised by the Office for Personal Data Protection (Úřad pro ochranu osobních údajů). The Czech Trade Inspection Authority supervises, within a defined scope, among other things, compliance with Act No. 634/1992 Coll., on Consumer Protection, as amended.

8. Personal data protection and cookies

  1. Information on the processing of the Buyer’s personal data (in particular for the purposes of performing the Purchase Contract, negotiating the Purchase Contract and fulfilling the Seller’s public-law obligations) under Regulation (EU) 2016/679 of the European Parliament and of the Council (General Data Protection Regulation, “GDPR”) is provided by the Seller in a separate document, the Privacy Policy, which is available on the Website (the “Privacy policy” page).
  2. The Seller uses analytics and marketing cookies only on the basis of consent given in the cookie banner; consent is not a condition for concluding the Purchase Contract, and the Buyer may change or withdraw it at any time via the “Cookie settings” link in the footer of the Website. The conclusion of the Purchase Contract is not conditional on consent to receiving commercial communications either.

9. Delivery of communications

  1. Communications to the Buyer may be delivered to the Buyer’s Email Address. Communications to the Seller may be delivered to the email address info@huggie.cz or to the address of the Seller’s registered office.

10. Final provisions

  1. If the relationship established by the Purchase Contract contains an international (foreign) element, the parties agree that the relationship is governed by Czech law. This choice of law does not deprive a Buyer who is a consumer of the protection afforded by provisions of the law of the country of their habitual residence that cannot be derogated from by agreement and that would otherwise apply in the absence of a choice of law under Article 6(1) of Regulation (EC) No 593/2008 of the European Parliament and of the Council of 17 June 2008 on the law applicable to contractual obligations (Rome I).
  2. If any provision of the Terms and Conditions is or becomes invalid or ineffective, it is replaced by a provision whose meaning comes as close as possible to the invalid provision. The invalidity or ineffectiveness of one provision does not affect the validity of the other provisions.
  3. The Terms and Conditions are drawn up in Czech; their translations into other languages are provided for the Buyer’s convenience. In the event of any discrepancy between language versions, the version more favourable to the Buyer applies.
  4. The Purchase Contract, including the Terms and Conditions, is archived by the Seller in electronic form and is not accessible to third parties. The Buyer receives the Terms and Conditions in text form as an attachment to the order confirmation email.
  5. The model form for withdrawal from the Purchase Contract forms an annex to the Terms and Conditions.
  6. Seller’s contact details: registered office FreshDeal s.r.o., Prievidzská 2921/23, 787 01 Šumperk, Czech Republic, email address info@huggie.cz. The address for returns and complaints is stated in Art. 5.3 of the Terms and Conditions.

These Terms and Conditions take effect on 1 November 2026.
